Faggett v. Alvarrez

County Court at Law #2 for Gregg County, Texas

Cause No.: 2016-1170-CCL2

Trial Date: May 23-24, 2018

Summary: This case involved a high speed collision, where my client crossed a high way, trying to beat traffic. Very significant property damage to the Plaintiff’s vehicle. Plaintiff was taken to the ER by EMS. She complained of neck, back, and shoulder pain. She ultimately had to undergo pain management and her medical bills totaled $68,000.00. Her pain management doctor testified that she needed additional injections over the next 10 years, and would require another $30,000 or so in medical treatment during that time. Plaintiff claimed to suffer from various falls as a result of the accident, as well. My client didn’t speak English, and had no valid driver’s license, which the jury was able to surmise from the testimony. The jury awarded all of the past medical, but only $2,000 for future medical, as it had been over 18 months since the Plaintiff’s last date of treatment. Plaintiff’s counsel asked the jury to award $250,000. I asked the jury to award $80,000.00.
