Summary: Defendant rear-ended Plaintiff. Plaintiff waited two days to treat, and when she did she went to an Urgent Care facility that converts to an ER after 4:00 pm. The issue in the case was the medical charges. The ER visit was Plaintiff’s only medical treatment, and we argued the charges were excessive. We filed controverting affidavits, and plaintiff’s counsel retained an expert to opine the charges were reasonable. Ultimately, the jury awarded the ER bill, and in discussions with them afterwards, they said it was because the parent tried to take her to the Urgent Care facility, and so she tried to avoid the hefty ER charges.
