Summary: Plaintiff was coming home from work as an overnight dispatcher for the Athens Police Department. It was around five a.m. and it was still dark outside. Defendant was on his way to the deer lease for the first day of bow-hunting season. He had an ATV in the back of his pickup truck that was improperly tied in the truck. The ATV fell out of the truck onto the highway. Plaintiff swerved to miss the ATV and flipped her truck. She was taken by ambulance to the ER. She later treated with her primary care doctor and a chiropractor for pain in her back and neck. Mr. Boyle sued for loss of consortium.

Economic Damages: $6,794.93 in medical bills and $1,425.00 in lost wages.

Last Demand: $25,000.00
